Why Parish Council's need a regulator with teeth?
Who does what?
I think it is useful to understand who does what in regards to any oversight of Parish Councils as at times it can certainly be confusing. To start of with most Parish Councils, certainly in Lincolnshire and I expect England, are members of the National Association of Local Government. NALC has County Associations which Parish Councils fall under and these CALC's (County Associations of Local Government) offer advice, training and support to Councils as well as other support services such as auditing. Although they are mainly there to serve Councils I do find if members of the public call up they are usually happy to answer any questions. Next you have the Principle Authority for Elections in the area, in some areas this is a District Council and others it may be a Unitary. These authorities with have a monitoring officer who can hold councillors to account if it falls bellow the code of conduct that Parish Council has adopted, usually it should be on their website. I would note in my experience the most severe thing these officers can do is usually a slap on the wrist. Next you have the Local Government Ombudsmen who can only act in scenario's where a Parish Council is doing something on behalf of a Principle Authority and it is limited to action on that activity only. So for example in Lincolnshire some Parish Councils are paid by the County Council to do grass cutting.
The other body the comes to mind if the Information Commissioner's Office who also have a narrow focus, since Parish Councils can be subject to Freedom of Information Requests like any public body they primarily deal with this. Finally we come to the External Auditors who ensure the Council is acting in a proper manner in accordance with policies and legislation and that the finances are all in order as well.
I view this current system as incoherent and fragmented at best with the hard truth that the only counter balance to a Council which is not fulfilling its duty is the ballot box. Parish Councils are able to make some extraordinarily bad decision with little scrutiny from poorly attend Parish Meetings and little Press Interest. Where as in a larger authority there is a system in place to detect issues within that authority it seems that a Parish Council can get away with it as long as they meet the bare minimum requirements of compliance. If more residents paid attention to what their Parish Councils are spending there money on I know that some would be at a loss of what the point of a Parish Council is. Even worse is when a Council keeps more money than they need in reserve with no plan to spend it, this simply results in a accumulation of wealth that serves no purpose.
There is a pressing need for a regulator/motivator who can keep Parish Councils in check to ensure they don't drift into being the one we all picture in the Vicar of Dibley. Parish Councils can be better but sadly there is little emphasise on pushing them to achieve more. If higher authority are set targets for improvement by national bodies and Central Government could the same be done for Parish Councils?
